1) Who we are & scope

These Terms of Service (“Terms”) govern your use of A 1 Flooring & Custom Showers’ website, communications (including SMS/MMS), quotes, estimates, work orders, and services (collectively, the “Services”). By using our Services, you agree to these Terms and our Privacy Policy.

2) Website use

You agree to use the website lawfully and not to attempt to disrupt or reverse-engineer it. Content on the site (text, images, logos) is owned by A 1 Flooring & Custom Showers and may not be copied without written permission.

3) Quotes, deposits, payments & change orders

Estimates/Quotes. Non-binding until accepted in writing. Pricing may be updated if site conditions or material availability change.

Deposits & Invoices. A deposit may be required based on project scope. Payment schedule and due dates will be stated on your estimate, invoice, or work order and become part of this agreement once accepted.

Change Orders. Any scope change, hidden condition, or customer-requested modification may adjust price and timeline. All changes will be documented and must be approved prior to work continuing.

Late/failed payments. We may pause work and/or charge reasonable late fees permitted by law. Title to any deliverables/materials does not transfer until paid in full.

4) Scheduling & site access

Customer is responsible for providing access to the jobsite during scheduled hours and for securing pets/valuables. Unavoidable delays (e.g., weather, supply chain, illness) may shift timelines.

5) Satisfaction guarantee (workmanship)

We stand behind our workmanship. If a workmanship-related issue arises after job completion, notify us promptly and we will make reasonable efforts to investigate and address it. This is not a manufacturer’s warranty and does not cover damage from misuse, lack of maintenance, normal wear, or issues caused by third parties or conditions outside our control.

6) Materials & manufacturer warranties

Any manufacturer warranties on materials are provided by the manufacturer, not A 1 Flooring & Custom Showers. We will assist you with reasonable documentation to support a claim.

7) Third-party services & referrals

We may recommend or integrate third-party services (e.g., payment processors, scheduling, messaging platforms). Those providers are solely responsible for their services. Your use of them is governed by their terms and policies.

8) SMS/MMS messaging terms (A2P/TCPA/CTIA)

By submitting a form, requesting a quote, providing your phone number to our team, or texting our number, you consent to receive SMS/MMS messages from A 1 Flooring & Custom Showers, which may include appointment updates, service notifications, and marketing/promotional messages.

Services are provided “as-is.” To the fullest extent permitted by law, A 1 Flooring & Custom Showers will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability related to any claim shall not exceed the amount paid by you for the specific job giving rise to the claim.

11) Indemnification

You agree to indemnify and hold A 1 Flooring & Custom Showers harmless from claims arising out of your breach of these Terms or misuse of the Services.

12) Governing law; disputes

These Terms are governed by the laws of the State of Alabama. Venue for disputes will be in the state or federal courts located in Alabama. (If you prefer arbitration later, we can add an arbitration clause—carriers don’t require it.)

13) Updates to Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Your continued use of the Services after an update means you accept the revised Terms.
